For the purposes of this chapter the following definitions shall apply:
Contractor licensee - shall mean the holder of a master, journeyman or apprentice license as described in this chapter.
Electrical work - shall include the installation, replacement, repair or alteration of disconnect, service or control equipment or of permanent premises electrical wiring, lighting, fixtures and/or utilization equipment or devices not otherwise connected by approved attachment cord and cap for a fixed sum, price, fee or any other compensation.
Electrical work - shall not include circuits and equipment operating at less than 50 volts, communication wiring or devices, or the repair of motors or utilization equipment.
Employee - shall mean a person working for a licensed contractor in a relationship of employee/employer as described by federal tax definition. Employee shall not mean independent contractor or subcontractor as described by federal tax definition.
HVAC mechanical work - shall include the installation, replacement, repair or alteration of any ventilation or exhaust system, chilled water system, hydronic, refrigerant, fuel gas or condensate piping, water heaters and boilers for both domestic hot water and space heating, refrigeration systems including electrical disconnecting means immediately adjacent to remote condensers, incinerators or other miscellaneous heat producing appliances or warm air heating systems whereby heating is accomplished by distributing heated air by forced or gravity circulation, or by radiation for a fixed sum, price, fee or any other compensation.
HVAC work - shall not include the installation or repair of cooking or clothes drying equipment, fully self-contained permanently electrical heating and/or cooling appliances such as but not limited to, ice machines, ice cream machines, walk-in coolers and freezers without remote condensers and other similar appliances which require only electrical and/or water hookups.
Person - shall mean an individual, corporation, limited liability company, or partnership.
Plumbing work - shall include the installation, replacement, repair or alteration of water, wastewater, vent, hydronic and fuel gas piping, water heaters and boilers for both domestic potable water and environmental heating and their vents, medical gas systems, plumbing fixtures and appliances for a fixed sum, price, fee or any other compensation.
Plumbing work - shall not include the clearing of stoppages or the repair of plumbing appliances such as but not limited to dishwashers, garbage disposals, water softeners or ice machines or yard/lawn irrigation installation, replacement or repair.
Roofing work – shall include the installation, repair and replacement of residential roof coverings.

Any person or corporation presently working as or desiring to engage in the practice of electrical work, plumbing work, HVAC work or roofing work, as described in section 5.20.101, shall provide certified proof of competency from a recognized testing agency in order to obtain a Contractor License to be issued by the City Clerk in accordance with this chapter. Contractor’s licenses issued pursuant to this chapter shall expire on December 31st of the year.

The contractor licenses and qualifications for each are as follows:
A. Plumbing Contractor or Gas Fitter. Unlimited on scope of plumbing work. Requires proof of Certification of Master Plumber or Journeyman Plumber or certification for a two (2) year program in the trade through an accredited community college, technical school, technical college, or proof of a minimum score of 75% on the ICC standard exam, the international association of plumbing and mechanical officials (IAPMO) standard exam or Prometric standard exam, or documented field experience of a minimum of three (3) years in the trade. “Documented field experience” for a plumbing contractor or gas fitter application requires written certification by a person with a master plumber’s license that the applicant worked under his or her direct supervision and is competent to work in this trade.
B. Mechanical Heating, Ventilation and Air Conditioning Contractor (HVAC). Unlimited in scope of mechanical, heating, ventilation and air conditioning work. Requires proof of certification of Master or Journeyman in heating, ventilation and air conditioning mechanics, or certification for a two (2) year program in the trade through an accredited community college, technical school, or technical college or a minimum score of 75% on the ICC, IAPMO or Prometric standard test, or documented field experience of a minimum of three (3) years in the trade. “Documented field experience “for a HVAC application requires written certification by a person with a master VAC license that the applicant worked under his or her direct supervision and is competent to work in this trade.
C. Electrical Contractor. Unlimited in scope of electrical work. Requires proof of certification of Master Electrician or Journeyman Electrician, or certification for a two (2) year program in the trade through an accredited community college, technical school or technical college or a minimum of 75% on the ICC, IAPMO or Prometric standard test, or documented field experience of a minimum of three (3) years in the trade. “Documented field experience” requires written certification by a person with a master electrician’s license that the applicant worked under his or her direct supervision and is competent to work in this trade.
D. Roofing Contractor. Authorized to install, repair and replace residential and commercial roof coverings. Requires state registration number and copy of certificate issued by Attorney General’s Office.

All skilled trade licensees who have been continuously licensed by the City of Belleville for a minimum of 3 years, prior to January 1, 2021, shall be eligible to renew their existing licenses without providing written certification of passage of a standard trade examination.

Effective January 1, 2021, applicants for issuance or renewal of a contractor’s license for plumbing, electrical of HVAC mechanical must verify completion of 12 hours biannually or six hours annually of continuing education hours of which six hours biannually or 3 hours annually shall consist of code education for the applicable skilled trade as proscribed by the State of Kansas.

Commencing with licenses to be effective on or after January 1, 2021, the annual fee for a contractor’s license to each person engaging in such work shall be as follows:
A. Plumbing Contractor $25.00
B. Electrical Contractor $25.00
C. HVAC Contractor $25.00
D. Roofing Contractor $25.00

No license or certificate of insurance shall be required if the skilled trade to be performed is accomplished:
A. By the owner of a residential or commercial structure, including the usual accessory structures. All paid subcontractors hired by the owner must be licensed.
B. Any person employed by a firm or corporation upon property owned or occupied by that firm or corporation.
C. Employees of the City of Belleville, in respect to work on the power and light system owned by the City of Belleville.

Before a license shall be issued for any contractor license, the applicant shall file with the city clerk a certificate of insurance providing for public liability coverage including bodily injury and property damage insurance coverage in an amount not less than $300,000 per occurrence and a general aggregate amount of not less than $300,000; provided further that such insurance coverage shall be effective at the time of any accident or property damage that is caused by the applicant herein, his agent, employee, lessee, or license. Such insurance policy shall contain all of the conditions required by the laws of the state of Kansas and shall carry a uniform endorsement for the actual notice to the city of any changes on such policy. The certificate of such insurance policy shall be provided on an accord certificate of insurance form, or other city approved form, and such certificate of insurance shall further provide that it cannot be canceled unless and until written notice is filed with the city clerk.

Only one proof of liability insurance shall be required for those persons obtaining multiple types of Contractor’s Licenses.

Any license issued under the provisions of this chapter may be revoked by the City of Belleville Governing Body upon proof that the licensee(s) has failed, neglected, or refused to comply with any of the provisions of this chapter or with other ordinances of the city relating to or regulating the particular type of work for which such license was granted: Provided, that no such license shall be revoked without the giving of a written notice of the intention to revoke such license and without giving such licensee a full opportunity to be heard before the governing body as to any complaint made against him or her. Upon the revocation of any license granted under the provisions of this chapter, no refund shall be made of any part of the license fee previously paid by the licensee. The city will not accept an application for a contractor’s license from that contractor for six (6) months from the date of revocation. Any contractor whose license is revoked must requalify for a license prior to reinstatement of that contractor’s license. Requalification shall include taking or retaking and passing any exams required for licensure by the city.

Any person, firm or corporation violating any provision of this chapter shall upon conviction thereof be fined in any sum not less than $50.00 nor more than $500.00, and each day’s continuance of such violation shall be considered a separate offense. Any conviction of a violation of the provisions of this chapter by a licensee shall be sufficient cause for the revocation of the license of such licensee.
