13.36.010.  Rules, regulations, compliance required.

The rates, rules and regulations hereinafter set forth shall constitute and be considered a part of the contract with every person, company, firm or corporation supplied with gas from the gas system of the city, and every person, company, firm or corporation, hereinafter called the consumer, who accepts and uses gas shall be held to have consented to be bound thereby.

13.36.020   Applications.

All applications for gas service shall be made in writing on a contract furnished by the city, stating the purpose for which the services are required.

13.36.030   City to make connections.

All taps shall be made, street excavations made, pipes installed and meter installed by city employees only. Only qualified City employees shall turn on or turn off gas service at the meter.

13.36.040   Connections, availability of Gas Service

With the approval of the City Manager, a property owner within the corporate city limits may be permitted to utilize a Liquid petroleum Gas Tank, as outlined in Chapter 8.36 based on the following:

A.    It is cost prohibitive for both the customer and the city to obtain natural gas service at the affected property, and;

B.    The estimated usage of natural gas by the potential customer is considerably lower than the average consumer.

13.36.050   Extension for services beyond city limits.

A.    City natural gas services shall not be extended beyond the city limits of the city, unless required by law or at the discretion and authorized by the governing body upon a finding that: (1) such service extension is not contrary to or is permitted by the laws of the State of Kansas and the ordinances of the city; or (2) that such service extension meets sound financial and economic standards; or (3) that such service extension is compatible with the mission and planning goals of the city.

B.    For property outside the corporate City Limits, but abutting up to the City limits, natural gas service may be extended to the property, contingent on the property being annexed into the City limits.  Once annexed into the corporate city limits, the owner shall comply with all ordinances of the city pertaining to natural gas services.

C.    For property outside the corporate City limits, but not abutting up to the Belleville City limits, at the property owner’s request, natural gas service may be connected if the natural gas system is readily available at the affected property.  Once connected the owner shall comply with all ordinances of the City pertaining to natural gas services.

13.36.060   Responsibility-City, Customer.

The city shall install and maintain gas service lines from the City mains up to the outlet side of the meter set on the owner’s property to be served with gas. The property owner shall pay the initial costs of the installation of the gas service pipe and thereafter the city shall maintain the service line at the expense of the city. Gas lines located from the outlet side of the meter to, and including inside the building, are the sole responsibility of the owner.

13.36.070   Meters.

The city shall install all gas meters at the building to be served with gas. In instances where it appears to be impractical in the opinion of the director of utilities to place a gas meter at the building, the gas meter will be placed at any other location on the property as in the opinion of the director of utilities is the most practical location. In all instances, meter placement shall be so arranged as to permit access to the same during ordinary business hours by City employees. All lines, meter placements and loops shall be constructed in accordance with the standards established by the city. The city shall install all meters and loops necessary to connect the gas service pipe to the building.

13.36.080   New service connection and valve installation fee.

A.    New Service Connection Fees

1.    Residential Services: A non-refundable fee of $400.00 will be charged for all new residential sized gas services.  For services over 40 feet, the cost will be an additional $3.50 per foot if the City trenches.  If the customer trenches, only the cost of material will be charged.

2.    Commercial/Large Services:  A non-refundable fee will be based on the cost of material to construct the service.  For services over 40 feet, the cost will be an additional $3.50 per foot if the City trenches.  If the customer trenches, only the cost of material will be charged.

B.    Installation Excess Flow Valve Fees.

1.    Existing Residential Steel Services: A non-refundable fee $400.00 will be charged.  For services over 40 feet, the cost will be an additional $3.50 per foot if the City trenches.  If the customer trenches, only the cost of material will be charged.

2.    Existing Commercial/Large Steel Services: A non-refundable fee will be based on the cost of material to construct the service.  For services over 40 feet, the cost will be an additional $3.50 per foot if the City trenches.  If the customer trenches, only the cost of material will be charged.

3.    Existing Residential or Commercial Plastic Services:  A non-refundable fee of $300.00 will be charged.

C.    City To Make Connections.  All taps shall be given, street excavations made, pipes installed from main line to meter and service line shall be connected by city employees only.

13.36.090   Rates for gas service

Effective on bills payable on effective noted below, and thereafter, the following rates shall be charged for natural gas furnished by the Belleville Municipal Gas Utility, and are hereby established to be charged against consumers of such natural gas through one (1) meter and not for resale:

(a)   Residential service consisting of direct natural gas usage in a dwelling for space heating, air conditioning, cooking, water heating, and other household purposes:

Monthly Charges

(1)   Customer Base per meter per month:                    $9.60

(2)   Commodity charge per meter per month:

First 1 MCF at $/MCF:                                        $9.195

All over 1 MCF at $/MCF:                                   8.695

(3)   Commodity charges for gas service under the rate set forth in (2) above shall be subject to the provisions of the Purchased Gas Adjustment clause set forth in Paragraph (c) herein.

(b)   Commercial service to customers engaged primarily in sale of goods or services including institutions and local, state and federal government agencies, churches, manufacturing and electric power generation:

Monthly Charges

(1)   Customer Base per meter per month:                    $21.00

(2)   Commodity charge per meter per month:

First 6 MCF at $/MCF:                                        $8.548

All over 6 MCF at $/MCF:                                   $7.658

(3)   Commodity charges for gas service under the rate set forth in (2) above shall be subject to the provisions of the Purchased Gas Adjustment clause set forth in Paragraph (c) herein.

(c)   Purchased Gas Adjustment (P.G.A.) clause

Rates and charges for metered gas service provided by the Belleville Municipal Gas Utility for the current monthly billing beginning on the 1st of each month may be increased by the amount of the P.G.A. per MCF unit billed to the City by its supplier(s) and transporter(s) when such annual purchase gas cost are projected by staff to be greater than 5.0% over the Base Rate Cost of $7.87, or to a level above $8.264/MCF.  The Council may then put a PGA in effect that is calculated in such amount  to recover such costs over the Base when applied to bills for a period of no longer than 12 months.

13.36.100   Service of pipes and fixtures.

The property owner shall keep fuel lines and not maintained by the City, in good repair and free from leaks at his/her expense.  No claims for damages shall be made against the city on account of breakage or leading of any valve or fuel line nor will any allowance by made to any consumer on account of any leaks or waste of gas after passing though the meter.

13.36.110   No inter-connections.

No plumber, consumer or other person shall extend pipes from one property or street number to another one.

13.36.120   Prohibited acts.

No person shall remove, obstruct, alter or injure any pipe, connection, valve, box, meter or in any way injure or damage any building, machinery, fixture, or appurtenance of the gas system of the city, or carry off or injure any pipe, tools, fixtures, supplies or apparatus, or other property appertaining to the gas system of the city
