Once a year, the City Council shall make a decision regarding the position of City Manager. Said decision shall be made by a simple majority vote. The powers and duties of the City Manager shall be fixed by ordinance. The City Manager shall be considered an employee of the city. The salary, benefits, terms, and conditions of employment of the City Manager shall be reduced to writing and approved by the governing body as a memorandum of employment, which shall be approved as a resolution by the governing body.

The City Manager shall be appointed solely on the basis of executive, managerial and administrative qualifications as demonstrated by a verifiable record of training and experience in public administration. The City Manager need not be a resident of the city at the time of appointment, but must reside in the City while in office. The person appointed City Manager of the City shall qualify for such office by taking and subscribing an oath to faithfully and to the best of his ability discharge all of the duties of such office, as provided by law and ordinance.

The City Manager may be removed by a majority vote of the Governing Body. The Governing Body shall provide reasonable notice of pending possible removal from office to the City Manager no less than two weeks prior to said vote. “Governing Body,” means the members of the city council and the mayor.

The City Manager shall be the chief administrative officer of the City, and shall be responsible to the Governing Body for administration of all City affairs placed in his or her charge by or under this charter ordinance, or any additional ordinances clarifying the duties of the City Manager. The City Manager shall:

A.    Be responsible for the administration of the affairs of the City.

B.    See that all laws and ordinances are enforced.

C.    Shall appoint, promote, transfer, assign, discipline, lay off, suspend, discharge, or remove all heads of departments, all subordinate officers, and employees, except the offices of Chief of Police, City Clerk, Municipal Judge, City Attorney, and other officers appointed by the Governing Body to act as appointed officials by ordinance.  The City Manager may authorize any appointive officer who is subject to his or her direction and supervision to exercise these powers with respect to subordinates of that officer.

D.    Shall prepare and submit the annual budget to the Governing Body, and also keep them fully advised as the financial needs and condition of the city.

E.    Provide assistance and advice to the Governing Body as needed, and shall make recommendations to the Governing Body on all matters concerning the welfare of the city.

F.    Shall have a seat and the right to take part in discussions, but no vote, in all meetings of the Governing Body.
