TITLE 8. HEALTH AND SAFETYTITLE 8. HEALTH AND SAFETY\Chapter 8.24 YARD WASTE AND MUNICIPAL TREE LANDFILL

A.    Yard Waste. Grass, grass clippings, leaves, yard trimmings, tree stumps, tree trunks, tree branches, tree trimmings and brush.

B.    Rubbish, Trash and Refuse. Combustible such as plastic, rubber, paper, lumber, wood products, oil and gas products, and non combustible such as metal, glass, stone, concrete, dirt and brick. Also residue from demolition of buildings, automobile or machinery or parts therefrom, dead animals, fowl, carcasses, spoiled grain, manure, hay, straw and solid waste resulting from industrial processes.

C.    City. Area within the corporate limits of Belleville, Kansas.

D.    Landfill Grounds. Located in the West One-Half (W 1/2) of Section One (1), Township Three (3) South, Range Three (3) West of the 6th P.M., Republic County, Kansas.

The landfill grounds shall only be open to the residents of the City of Belleville to deposit yard waste.

It shall be unlawful for any person, firm, corporation or organization to deposit any trash, rubbish, refuse or other waste matter in the Municipal Tree Landfill.

Said landfill shall be kept open for the use of those having need according to the rules and regulations as adopted by the Governing Body of the City of Belleville, from time to time and posted at said landfill area. Said landfill grounds shall not be used for dumping purposes except during the hours specified for the same to be kept open.

The landfill grounds shall be substantially enclosed with a fence, and the entrance thereto provided with a gate, which may be locked except during the open hours as specified by the Governing Body, and all entrance to said landfill grounds shall be through said gate entrance.

Any person hauling yard waste to said landfill grounds shall deposit the same therein at such place as may be designated by signs.

No explosive or other material, dangerous to the safety of persons or property, shall be deposited in the landfill grounds at any time.

No minor under the age of sixteen (16) shall enter or use the landfill grounds unless accompanied by his or her parent, guardian or legal custodian or an adult.

It shall be unlawful to shoot fire-arms of any type in the landfill grounds.

No persons shall ignite or start any fire or fires in said landfill grounds, other than persons authorized by the City Council.

The City of Belleville, Kansas, shall not, in any case, be responsible to any person, firm or corporation for any accident, loss, injury or damage to any person or property by reason of any use or entry into the Municipal Tree Landfill Grounds or the deposit of any materials therein.

The City of Belleville Police Department shall exercise supervision over said Municipal Tree Landfill Grounds.
